2. General conditions of use (CGU)
Objective:
Access to the designelite.fr site implies full and complete acceptance of these general conditions of use. The user undertakes to use the site in compliance with the laws in force, not to undermine the security of the site, and not to attempt to alter its content.
The site may contain links to external resources, Design Elite declines all responsibility for their content or operation. Design Elite reserves the right to change these terms and conditions at any time without notice.

Design Elite is a subscription-based design studio offering services in graphic design, visual identity, web design, UX/UI, motion design, illustration, and any creative service accessible via its monthly subscription plans (hereinafter "the Services").
Article 2. Scope and Acceptance
These General Terms and Conditions of Sale ("GTC") govern all contractual relations between Design Elite and any natural or legal person (hereinafter "the Client") subscribing to one of its subscription plans or ordering a one-off service.
Subscribing to a plan or paying a first invoice implies full and complete acceptance of these General Terms and Conditions, without reservation or restriction. The Client declares having read them before placing any order.
Design Elite reserves the right to modify these General Terms and Conditions at any time. Modifications take effect on the date of their publication on the website. The applicable General Terms and Conditions are those in effect on the date of subscription or renewal of the subscription.
Article 3. Plan Descriptions
Design Elite offers the following monthly subscription plans (indicative prices excluding taxes, subject to change):
3.1 Prestige Plan
- 3 design requests per month
- 1 active request at a time
- Unlimited revisions
- Dedicated project manager
- Access to the Design Elite platform
- Weekly video call
- Centralized communication (Slack, WhatsApp, email)
3.2 Elite Plan
- Unlimited design requests
- 1 active request at a time
- All the benefits of the Prestige Plan
3.3 Commando Plan
- Unlimited graphic requests
- Up to 2 active requests in parallel
- Motion design, UX wireframing, art direction included
- All the benefits of the Elite plan
3.4 Custom Enterprise Plan
Custom plan tailored for large accounts (customized volumes, deadlines, processes, and invoicing). Specific conditions are subject to a separate contract.
The details of services included in each plan, the indicative delivery times, and any exclusions are specified on the Pricing page of the www.designelite.co website and in the quote or purchase order issued upon subscription.
Article 4. Ordering and Subscription
Subscriptions are made via the www.designelite.co website, after a qualification call with the Design Elite team, or directly via a secure payment link. The subscription is considered finalized upon receipt of the first monthly payment or the signing of a purchase order.
Design Elite commits to sending a confirmation email summarizing the subscribed plan, the amount, the effective date, and platform access details within 24 business hours following the order.
For Professional Clients, a purchase order or agreement can be issued upon request. In the absence of a specific contractual document, these General Terms and Conditions of Sale (GTC) prevail.
Article 5. Prices and Payment Terms
5.1 Prices
Prices are expressed in euros, excluding taxes (excl. VAT). The applicable VAT at the legal rate in force will be added to the invoice. As Design Elite may invoice from France, French VAT (20%) applies to Clients established in France. For Clients established in another European Union Member State who are subject to VAT and hold a valid intra-community VAT number, reverse charge may apply. For Clients outside the EU, no VAT is applicable.
Discounts are granted for commitments of 3, 6, or 12 months, according to the conditions displayed on the Pricing page. These discounts cannot be combined.
5.2 Billing and Payment
Billing is monthly, in advance. Payment is made by direct debit via the secure Stripe payment solution or by bank transfer upon presentation of an invoice.
Invoices are issued at the beginning of each monthly period and are payable upon receipt, unless otherwise agreed in writing. For fixed-term plans, payment can be made in a single installment or monthly, according to the Client's choice at the time of subscription.
5.3 Late Payment
Any delay in payment will automatically result, from the day after the due date, in the application of late payment penalties at the legal interest rate in force plus 5 points, as well as a fixed compensation of €40 for recovery costs (in accordance with Article L. 441-10 of the Commercial Code). Design Elite reserves the right to suspend access to the Services without prior notice in the event of non-payment by the due date, after a formal notice has remained without effect for 5 business days.
Article 6. Duration, Renewal, and Termination
6.1 Duration
Flexible subscriptions are taken out on a month-to-month basis from the activation date. Fixed-term subscriptions (3, 6, or 12 months) are concluded for the duration chosen at the time of subscription.
6.2 Renewal
At the end of the initial period, the subscription will automatically renew for successive monthly periods, unless terminated by either party under the conditions defined below.
6.3 Termination Without Commitment
For subscriptions without a commitment period, the Client may terminate at any time by notifying Design Elite in writing (email to [email protected] or via the client area) with a minimum of 7 calendar days' notice before the next renewal date. After this period, the next monthly payment is due in full.
6.4 Termination with Commitment
For subscriptions with a commitment period, early termination will result in the immediate payment of the remaining monthly fees due until the end of the commitment period, after deducting any granted discounts. No refunds will be issued for monthly fees already paid.
6.5 Subscription Pause
The Elite and Commando plans allow for subscription pausing. A pause can be requested once per 3-month period, for a maximum duration of 30 days. During the pause period, no requests can be submitted, and no invoicing will occur. The pause period will be deducted from the next billing cycle. Design Elite reserves the right to approve or refuse a pause request based on internal organizational constraints.
6.6 Termination for Cause
Design Elite reserves the right to terminate the subscription automatically, without notice or compensation, in the event of a serious breach of obligations by the Client (including non-payment, fraudulent use, or violation of these General Terms and Conditions of Sale). In this case, any outstanding amounts remain payable.
Article 7. Production Process and Lead Times
Design Elite commits to processing requests according to the estimated lead times published on the website. These lead times begin upon receipt of a complete brief validated by the project manager. Any incomplete or ambiguous brief, or one requiring additional information, will suspend the lead time until the missing elements are received.
The estimated delivery times are as follows, depending on the type of deliverables:
- Print materials, logo, visual identity, web design: 1 to 2 business days
- Presentation, illustrations, ebook, UX/UI, social media templates, creative ads: 2 to 3 business days
- 3D, motion design, full website, website redesign, UX wireframe: 3 to 7 business days
These deadlines are indicative and may vary depending on project complexity, the volume of ongoing requests, and the Client's responsiveness for feedback and approvals. Design Elite cannot be held responsible for delivery delays resulting from the Client's late provision of information.
Requests are processed in order of submission, according to the prioritization defined with the project manager. Only the number of simultaneously active requests is limited based on the subscribed plan.
Article 8. Revisions and Deliverable Approval
Design Elite offers unlimited revisions on each deliverable, within the scope of the validated initial brief. A revision corresponds to consolidated feedback from the Client on a delivered version. Design Elite is not obligated to treat fragmented, successive, and unconsolidated feedback as distinct revisions.
Revisions do not constitute substantial modifications to the initial brief. Any request involving a major change in creative direction, a significant expansion of scope, or a complete overhaul of existing work may be subject to a new, separate request.
A deliverable is considered approved and final in the following cases:
- Explicit written validation from the Client or via the platform
- No feedback from the Client within 14 calendar days following delivery
- Publication or use of the deliverable by the Client
Design Elite cannot be held responsible for the consequences of a deliverable used without formal approval.
Article 9. Intellectual Property and Assignment of Rights
9.1 Client's Rights to Deliverables
Upon full payment of all sums due, Design Elite exclusively and irrevocably assigns to the Client the economic copyright on the definitively approved deliverables, for all commercial use, on all media, and without geographical limitation, for the legal duration of copyright protection.
This assignment includes the rights of reproduction, representation, adaptation, translation, distribution, and public communication in any form known or unknown to date. Source files (native formats: .ai, .psd, .fig, .xd, .ae, etc.) are provided with the final deliverables.
9.2 Design Elite's Rights
Design Elite retains the right to mention the Client in its commercial references and to showcase the deliverables in its portfolio, marketing materials, social media, and website, unless otherwise agreed upon in writing by the Client.
9.3 Third-Party Content
If the creation of a deliverable requires the use of third-party elements subject to rights (agency photographs, commercial fonts, stock illustrations, plugins), it is the Client's responsibility to acquire the necessary licenses or to inform Design Elite beforehand. Design Elite cannot be held responsible for any violation of third-party rights resulting from the use of elements provided by the Client or requested without specifying their legal status.
Article 10. Client Obligations
The Client agrees to:
- Provide clear, complete, and sufficiently detailed briefs to enable the timely completion of deliverables
- Designate one or more authorized contacts to validate deliverables and provide feedback on behalf of the organization
- Respond to requests for additional information from the Design Elite team within a reasonable timeframe
- Do not disclose its platform login credentials to unauthorized third parties
- Use the deliverables in compliance with applicable laws and regulations, including those concerning copyright, comparative advertising, personal data, and trademark law
- Ensure that the elements provided to Design Elite (texts, images, logos, data) do not infringe upon the rights of third parties
Article 11. Design Elite's Obligations
Design Elite commits to:
- Assign qualified designers and a dedicated project manager to each client account
- Respect the confidentiality of information and data transmitted by the Client
- Use up-to-date tools and technologies for the creation of deliverables
- Process requests in an order of priority agreed with the Client
- Inform the Client of any obstacle likely to impact delivery within the agreed deadlines
- Maintain the Design Elite platform available and functional with a reasonable level of availability
Article 12. Confidentiality
Each party undertakes to treat as strictly confidential all information, data, documents, strategies, financial or otherwise, communicated by the other party within the framework of these GTC, and not to disclose them to third parties without the prior written consent of the other party.
This confidentiality obligation does not apply to information that is or becomes publicly available without fault of the receiving party, or whose disclosure is required by law or a court order.
Design Elite processes the personal data of the Client and its representatives in accordance with the General Data Protection Regulation (GDPR) and its Privacy Policy available on the website.
Article 13. Liability and Guarantees
13.1 Limitation of Liability
Design Elite is bound by an obligation of means. Its liability can only be engaged for direct damages resulting from a proven fault on its part. In no event shall Design Elite be liable for indirect damages, including but not limited to: loss of turnover, loss of clientele, damage to reputation, commercial prejudice, or loss of data.
In any event, Design Elite's total liability, all causes combined, is limited to the total amount of sums actually received by Design Elite from the Client during the 3 months preceding the event giving rise to liability.
13.2 Force Majeure
Design Elite shall not be held liable for any delay or non-performance resulting from a force majeure event as defined in Article 1218 of the Civil Code, including but not limited to: natural disasters, pandemics, cyberattacks, failures of essential third-party providers, strikes, or IT service interruptions. Design Elite will inform the Client as soon as possible of the occurrence of such an event.
Article 14. Subcontracting
Design Elite reserves the right to use subcontractors or freelancers for the performance of all or part of the services, without requiring the Client's prior consent. Design Elite remains solely responsible to the Client for the proper execution of the services, even when using subcontractors. The confidentiality and assignment of rights obligations set forth in these General Terms and Conditions apply to all Design Elite subcontractors.
Article 15. Non-Solicitation Clause
For the duration of the subscription and for a period of 12 months following the effective end date of the contractual relationship, the Client undertakes not to recruit, poach, or directly engage, for any reason whatsoever, Design Elite's designers, project managers, or collaborators with whom they have been in contact in connection with the services, without Design Elite's prior written consent.
In the event of a breach of this clause, the Client shall pay Design Elite a lump sum compensation equivalent to 6 months of the subscription amount at the time of the breach, without prejudice to any additional damages.
Article 16. Affiliate Program
Design Elite offers an affiliate program allowing partners who refer new clients to receive a commission according to the conditions published on the dedicated page of the website. This program is subject to specific conditions available at www.designelite.co/affiliate, which apply in addition to these GTC.
Article 17. Governing Law and Jurisdiction
These GTC are governed by French law. In the event of a dispute relating to the interpretation, execution, or termination of these GTC, the parties undertake to seek an amicable solution within 30 days from the notification of the dispute by either party.
Failing an amicable settlement, any dispute shall be subject to the exclusive jurisdiction of the Commercial Court of Paris, notwithstanding multiple defendants or third-party claims.
Article 18. Miscellaneous Provisions
Entire Agreement: These GTC, supplemented where applicable by a purchase order or a specific agreement, constitute the entire agreement between the parties and supersede any prior agreement, commitment, or negotiation.
Severability: If any clause of these GTC is declared null or unenforceable by a competent court, the other clauses shall remain in force unaffected.
Non-Waiver: Design Elite's failure to exercise any provision of these GTC at any time shall not constitute a waiver of its right to exercise such provision later.
Notifications: Any notification under these GTC must be sent by email to [email protected] (for Design Elite) and to the email address provided during subscription (for the Client), unless otherwise specified.

Cookies are placed only with your consent, via the banner displayed during your first visit. You can deactivate them at any time from your browser settings or via our cookie management tool.
The types of cookies used include:

No personal data is sold to third parties.
5. Refund policy
Design Elite memberships are non-binding, but non-refundable. Any monthly period started is due in full, even if the service is not used.
In the event of a proven malfunction or a manifest error on our part, a commercial gesture or a credit note may be offered at the discretion of the Design Elite team. No refunds will be made for reasons related to the perception of quality, as an unlimited revision system is included in the service.
